Complainant Shihab Bashir jailed for six months in cheque fraud case<\/p>\n\n\n\n
Dhaka : The High Court has stayed criminal proceedings against five senior officials of foodpanda Bangladesh and issued a rule questioning the legality of the cases pending with the Chief Metropolitan Magistrate (CMM) Court in Dhaka.<\/p>\n\n\n\n
The complainant in the supplier dispute, Md. Shihab Mahmud Bashir, has been sentenced to six months\u2019 imprisonment and fined Tk 5 lakh by a Dhaka court, in another case related to payment default, filed by a foodpanda entity.<\/p>\n\n\n\n
A High Court Division bench comprising Justice Razik-Al-Jalil and Justice Md Ashif Hasan stayed the proceedings in response to petitions challenging the cases filed by Bashir, a former supplier of Delivery Hero Stores (Bangladesh) Ltd, which operates pandamart, a concern of foodpanda Bangladesh.<\/p>\n\n\n\n
The five foodpanda officials also secured regular bail from the CMM Court in the past week. Under the High Court order, proceedings against them before the lower court will remain stayed until further orders.<\/p>\n\n\n\n
On 11 October, 2026, the Additional Metropolitan Magistrate Court, Dhaka, sentenced the ex-supplier of Delivery Hero, Shihab Bashir, in one of three cheque dishonour cases filed by Delivery Hero Stores (Bangladesh) Limited under the Negotiable Instruments Act, 1881.<\/p>\n\n\n\n
In 2022, IPLE Distribution Network, owned by Bashir, began supplying goods to pandamart through Delivery Hero Stores (Bangladesh) Ltd. The company later ended the business relationship after issues with product supply and fulfilment arose. The two sides subsequently became embroiled in a dispute over outstanding dues.<\/p>\n\n\n\n
The two sides came to an agreement to settle the matter; the company agreed to waive part of its claim, and Bashir issued three cheques which were dishonoured for insufficient funds. Upon completing due process, the company filed three separate cheque dishonour cases in 2025 against Bashir under Section 138 of the Negotiable Instruments Act.<\/p>\n\n\n\n
Bashir then brought four criminal cases against five senior foodpanda Bangladesh officials (in 2025). They include the company’s co-founders and managing directors, Ambareen Reza and Zubair BA Siddiky.<\/p>\n\n\n\n
The cases involve allegations of cheating, criminal breach of trust, and disputed adjustments relating to returned goods, known as return to vendor (RTV).<\/p>\n\n\n\n
foodpanda considers filing of criminal cases over commercial disputes as retaliatory action since they were filed after Delivery Hero initiated legal proceedings to recover the outstanding dues.<\/p>\n\n\n\n
In its petitions filed with the High Court, foodpanda Bangladesh challenged the legality of the cases against its officials. The court issued a rule and stayed the proceedings covered by its order before the lower court. The rule is yet to be disposed of.<\/p>\n\n\n\n
foodpanda conducts its business in accordance with applicable laws of the land and contractual obligations. In its legal battle, the company will seek appropriate legal remedies.
